Judge in Indiana says drunk driving doesn't always lead to prison

All sorts of risks and hazards are present to motorists on Indiana roadways. Some are inherent to the road, others may be present because of inclement weather or other naturally occurring conditions. However, sometimes individual choices can lead to unfortunate circumstances, such as when an accident occurs because of drunk driving.

The law is strict with regard to those who have been arrested and convicted multiple times for driving under the influence of alcohol. Repeat offenders do not always end up in prison, though. In fact, a judge in Indiana recently stated that he does not believe prison is always the best option for someone who has been convicted of driving drunk repeatedly.

A 38-year-old man who was recently convicted for his eighth offense has been ordered to enter a drug program, rather than go to jail. The program lasts two years and participants must undergo counseling, alcohol and drug tests, and community service on a regular basis. The judge stated that there are many ways other than jail to hold convicted persons accountable for their actions.

More than likely, an experienced criminal lawyer would be able to request alternative sentencing on behalf of a person convicted of drunk driving in Indiana. It is typically advisable to request a consultation with a legal representative as soon as possible after an arrest has taken place. An attorney can investigate the events leading up to and following an arrest to make certain that none of a defendant's personal rights have been violated during interactions with law enforcement agents or court officials.
